Capital One Getaway Giveaway Sweepstakes Official Rules NO PURCHASE OR OBLIGATION IS NECESSARY TO ENTER OR WIN A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING 1 Eligibility The Capital One Getaway Giveaway Sweepstakes (the “Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of and older as of date of entry and who are members of a Capital One Travel Rewards program as of 6/1/11. Employees of and independent contractors working on behalf of Capital OneN A (“Sponsor”), its affiliates, subsidiaries, the judging agency and any other individual or company involved in the development, promotion or execution of the sweepstakes, including advertising, promotional and service agencies, including The Ignition Network, LLC (“The Ignition Network”), and the immediate families (spouse, and parents, children, and siblings and their spouses) and individuals living in the same households of such employees are not eligible. Beginning at 12:00;00 AM Eastern Time (“ET”) on 6/1/11 and ending 11.59:59 PM ET on 6/30/11 (the “Promotion Period”), a Capital One Travel Rewards Member will automatically receive one (1) entry into the Sweepstakes upon redeeming miles or points online for airline tickets, car rentals, hotel or vacation packages. Entries will be included in the Daily Grand Prize Drawing for the day the redemption is submitted For purposes of this Sweepstakes, a “day” begins at 12:00:00 a.m ET and ends at 11:59:59 p.m. ET. If a member redeems multiple times in a day. in separate redemption transactions, each redemption transaction will result in one entry into the Daily Grand Prize Drawing for that day. To Enter Without Obligation (and without redeeming miles or points) Hand-print your first name, last name, street address (no P.O. Boxes), city, state, ZIP code, e-mail address (if available), dav and evening telephone numbers, and complete birth date (including year of birth) on a 3” x 5” piece of paper and mail it first class to “Capital One Travel Giveaway” Sweepstakes Entries, P.O. Box 1322. South Bend. IN 46624-1322 (a “Mail-in Entry”). A mail-in entry will be entered into the Sweepstakes Drawing for the day the mail-in entry is postmarked provided it is received by 7/7/11. Mail-in Entries must be postmarked 6/30/11 to be included in the final drawing. Limit one entry per outer postmarked envelope. Mechanically reproduced entries are not permitted and will be disqualified. Sponsor is not responsible for lost, late, misdirected, damaged, incomplete, illegible or postage-due mail or entries, all of which are void. Entries become the property of Sponsor and will not be returned 3 Random Drawing: There will be thirty (30) Grand Prize random drawings, with one (1) Grand Prize winner selected from among all eligible entries for each day of the Promotion Period (each a “Daily Grand Prize Drawing”). Non-winning entries will not be carried over into subsequent drawings. All Daily Grand Prize Drawings will be conducted on or about 7/14/11 by The Ignition Network, an independent judging organization, whose decisions are final on all matters relating to this Sweepstakes. 4 Odds: Odds of winning a prize will depend on the total number of eligible entries received for each drawing. 5 Prizes Winners will be awarded the number of miles or points redeemed for the selected redemption transaction, Average approximate retail value (“ARV”) per prize (based on the average redemption transaction of 55.011 pomt or miles) is $515.00. The actual value will vary based on the number of miles or points redeemed for each winning redemption transaction. For example, if a customer redeems points for a rental car worth 500 points and is the daily winner, those 500 points will be reimbursed to the customer’s account within 4-6 weeks of winner verification. The prize will be awarded in the form of a miles or points credit to the winner’s Capital One Travel Rewards account. If a Mail-in Entry is selected as a Grand Prize winner, winner will receive 55.011 rewards points or miles awarded in the form of a credit to the winner’s Capital One Travel Rewards account ARV: $515 00. There are 30 daily prizes with a total ARV of Prize Pool (based on the average redemption transaction) of $15,450. 6. Winner Notification/Prize Claims: Each potential winner will be notified by phone, e-mail and/or mail, and will be required to complete and sign an Affidavit of Eligibility and Liability Release and where legal, a Publicity Release, and a W9, all of which must be returned within ten (10) days of attempted prize notification. In the event of noncompliance with these Official Rules, or if the above mentioned documents are not returned within ten (10) days of attempted prize notification or if prize notification is returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner. Prize winners will receive their rewards points or miles within 4-6 weeks of winner verification, 7. Additional Terms: By accepting a prize and by completing and signing the Affidavit of Eligibility and Liability Release and where legal, a Publicity Release, and a W9, winners consent to the use of their names, likenesses, voices and/or biographical information for advertising and promotional purposes without additional compensation, except where prohibited by law. Winners will be required to participate in a thirty (30) minute interview with Sponsor (or agency designated by Sponsor). Federal, state and local taxes, if any, are the sole responsibility of winner. All winners, by acceptance of prize, agree to release and hold Sponsor, its affiliates, subsidiaries and each company’s respective officers, directors, employees, independent contractors, representatives and agents (“Releasees”) harmless from and against any claim or cause of action arising out of participation in the sweepstakes or the receipt, redemption or use of a prize, including any injuries or damages of any kind sustained in connection with the use, acceptance, possession or awarding of any prize. By participating in this Sweepstakes, you agree to be bound by the Official Rules and by the decisions of Sponsor and the judging agency, which are final and binding on all matters. Sponsor reserves the right to modify prize award procedures at its discretion. 8. Limitation of Liability. Sponsor is not responsible for late, lost, misdirected, mutilated, incomplete or illegible entries. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by entrant or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error which may occur in the processing of the entries. Sponsor is also not responsible for any technical problems, malfunctions of any telephone service, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission that may affect the ability of consumers to participate, or for any damage to any participant’s computer system/software related to or resulting from participation in this Sweepstakes. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. In the event Sponsor is prevented from continuing with the Sweepstakes or the integrity and/or feasibility of the Sweepstakes is severely undermined by any event beyond the control of Sponsor, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus, unauthorized intervention, technical failures or other cause not reasonably within the control of Sponsor (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes. If Sponsor, in its discretion, elects to alter this Sweepstakes as a result of a Force Majeure event, a notice will be posted on capitalone.com. In the event of cancellation, Sponsor will award the prizes in a random drawing from among all valid and eligible entries received up to the time of such cancellation, providing a sufficient number of entries are received. By participating in this Sweepstakes and submitting an entry, each entrant agrees: (i) to be bound by these Official Rules, including all entry requirements; (ii) to hold Sponsor, its representatives, directors, officers, agents, divisions, dealers, affiliates, subsidiaries, distributors, advertising and promotional agencies, employees and assigns (collectively, the “Released Parties”), harmless against any and all claims, injuries, damages, losses and liability that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of any prize or any travel or activity related to the receipt or use of any prize; and (in) that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. As a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the prizes awarded shall be governed by the laws of the State of Virginia without giving effect to any choice of law or conflict of law rules, and that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a court located in Richmond, Virginia.
